One of the biggest lies men are told is that they do not have the same rights as women in a divorce proceeding. In the State of Missouri the sex of a party, legally, has no bearing on a Court’s decision in awarding custody, maintenance, child support, or property division. Never-the-less, men repeatedly find themselves feeling defeated for the sole reason that they are a man.

While some judges may favor the traditional/matriarchal model of parenting that vests the mother as the primary caretaker and the father as the primary provider (or money maker), the decision of who will spend more time with a child or take a lead role in traditional family decisions (i.e. medical, educational, and religious decisions) generally rests on the level of each spouse's involvement in the children's lives. If both parents are working full-time and share parenting duties equally (50/50), then the man (father) has just as good of an opportunity to be named the custodial parent as the mother.

Conventional wisdom would point its finger toward a change in legal precedence and jurisprudence (the Judge’s underlying logic and reasoning), but the truth of the matter is that fathers are becoming more involved and mothers are becoming less involved in comparison to their 1970’s generational counter-parts.

The concept that men are less equipped to parent or take on traditional child care roles is antiquated at best, and perpetuates a fallacious line of reasoning that would prefer our society in the dark ages.

The same logic can be applied to a person’s ability to work, earn income, own property, and pay maintenance or support. While a delayed glass ceiling still exists, the ability and opportunity for women to break through that glass ceiling has never been greater.
